The Public Hearing date for this application is 9/21/04.

Site Walk 9/4/04 at 9:00 a.m.; Decision and Public Hearing by 10/19/04.)
MOTION: To set the Public Hearing for File #2004-22 for September 21, 2004.

H. Minutes
One change was requested on the August 17, 2004 minutes: on page 1, remove “(alt.)” next to M. Dinallo’s name.

I. Correspondence/Staff Report

Concerning #1, Yorgensen said she would send the form back to Amy Moore with the letter and application because her Special Permit did not give her any outside space. A modification of her Special Permit is required.
Yorgensen said that 4.993 acres of land that the DEP owns next to the recreation field will be deeded to the town for recreational purposes. It is near the commuter lot, adjacent to the River Road Recreation project at Exit 70 of Route 84.
J. Discussion
St. Louis asked what’s happening with the PoCD. Yorgensen she does not know where it lies at this point. St. Louis asked if the town has met its financial obligation for the PoCD, and Yorgensen replied no.
Latincsics asked about progress on the new town library. Yorgensen said no applications or plans had been received by her office as of yet. The First Selectman has informed her that the architect has promised that the engineers plan will be final in about a week from now and will be submitted to the Health District and then Inland Wetlands. . In addition, they are applying for a grant.
St. Louis asked if the Senior Center has received their Certificate of Occupancy, and Yorgensen said not yet. The main piece that is missing is the as built.
Rob Hisey said he had put a complaint in on May 27; he did receive a reply from Wetlands but hadn’t so far from P&Z. He asked what the Commission’s intentions were, since there is a six-month time limit for filing intent to sue with the Town Clerk.
Latincsics recused himself from the matter, and asked Yorgensen to review the status of this complaint. Yorgensen said that at a previous meeting copies of the letter were passed out to be read and discussed later. She asked Mr. Hisey to clarify if what he said was that if he did not receive a response to a “complaint” within six months he could sue the Town? Mr. Hisey said that he could file intent to sue within six months and then had two years to file the suit.
Mr. Fox of Eldredge Mills Road asked if a PowerPoint presentation could be done at a Public Hearing. Yorgensen said yes, as long as he provides both digital and a paper copy of the slides for our records. Mr. Latincsics also added that the presentation should be brief in order to be fair to all parties. Mr. Fox said it would.
